1. Services Provided
Gardener Thornton Heath offers a comprehensive range of gardening services, including but not limited to lawn maintenance, hedge trimming, planting, weeding, and garden design. All services are performed by trained and experienced professionals.
1.1 Scope of Work
- Regular Lawn Mowing
- Hedge and Shrub Trimming
- Flower Planting and Maintenance
- Weed Control Services
- Garden Design and Installation
2. Pricing and Payment
Our pricing structure is designed to be transparent and competitive. All service fees will be outlined in the service agreement provided prior to commencement of work.
2.1 Payment Terms
- Payments are due upon completion of the service unless otherwise agreed upon.
- We accept various payment methods, including cash, credit/debit cards, and bank transfers.
- Late payments may incur additional charges as specified in the service agreement.
3. Cancellation and Rescheduling
We understand that schedules can change. To cancel or reschedule a service, please notify us at least 48 hours in advance. Failure to do so may result in a cancellation fee.
3.1 Cancellation Fees
- 24-48 hours notice: No cancellation fee.
- Less than 24 hours notice: 50% of the scheduled service fee.
- No-show without notice: 100% of the scheduled service fee.
4. Liability and Insurance
Gardener Thornton Heath is fully insured to cover any accidental damages that may occur during the provision of our services. However, we are not liable for pre-existing conditions or damages caused by factors beyond our control.
4.1 Client Responsibilities
- Ensure that the work area is accessible and free from hazards.
- Inform us of any known issues or special requirements related to your garden.
5. Changes to Services
Any changes to the scope of work must be agreed upon in writing by both parties. Additional services may incur extra charges as outlined in the service agreement.
5.1 Amendments
- All amendments must be documented and signed by an authorized representative of both parties.
- Changes requested after the commencement of services may affect scheduling and pricing.
6. Termination of Services
Either party may terminate the service agreement with written notice. Upon termination, any outstanding payments for services rendered up to the termination date will be due immediately.
6.1 Grounds for Termination
- Breach of terms and conditions by either party.
- Non-payment of agreed fees.
- Failure to comply with safety or site access requirements.
7. Confidentiality
All personal information provided by clients will be kept confidential and will not be shared with third parties without explicit consent, except where required by law.
7.1 Data Protection
- We adhere to all relevant data protection regulations.
- Clients have the right to access and request the deletion of their personal data.
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which Gardener Thornton Heath operates. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in this area.
8.1 Dispute Resolution
- In the event of a dispute, both parties agree to attempt to resolve the matter through mediation before pursuing legal action.
- Failure to resolve disputes through mediation may lead to arbitration or litigation as appropriate.
9. Intellectual Property
All content, designs, and materials created by Gardener Thornton Heath in the course of providing services remain the intellectual property of the company unless otherwise agreed upon in writing.
9.1 Use of Materials
- Clients may use photos and descriptions of completed work for personal use.
- Commercial use of Gardener Thornton Heath materials requires explicit written permission.
10. Amendments to Terms and Conditions
Gardener Thornton Heath reserves the right to modify these terms and conditions at any time. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of the updated terms.
10.1 Notification of Changes
- Changes will be communicated via email or through our official communication channels.
- It is the client's responsibility to review the terms periodically.
